Before You Build: How HOA Architectural Review Works in Colorado

General information only, not legal advice.

Planning a new fence, paint color or patio project? In most HOAs, exterior changes need approval before work begins. That's what architectural review is for.

What is the ARC?

ARC stands for architectural review, the process (often handled by an Architectural Review Committee) for reviewing owner requests for exterior changes. The goal is to keep the community consistent with its design guidelines and governing documents.

How the process usually works

  1. Check your community's design guidelines. They often list approved colors, materials and styles.
  2. Submit a request with details such as plans, materials and colors.
  3. The committee or board reviews it.
  4. Wait for written approval before you start.

Getting approval first helps keep your community looking its best and can save you from costly do-overs.

What Colorado law says about common projects

Water-wise landscaping

For detached single-family homes, SB23-178 says the HOA can't ban xeriscape or drought-tolerant landscaping, must allow an option with at least 80% drought-tolerant plants and can't prohibit vegetable gardens. HOAs must offer at least three preapproved water-wise front-yard designs but can still adopt reasonable design guidelines. These protections don't apply to condos or attached townhomes.

Plug-in solar devices

HB26-1007 (effective August 12, 2026) makes covenants or rules that unreasonably prohibit portable plug-in solar devices unenforceable. HOAs can still set reasonable rules on notice, safety, location and securing the device.

Accessory dwelling units

HB24-1152 voids HOA rules that prohibit an ADU on a lot with a single-family detached home, but only in cities and counties covered by the state's ADU law. HOAs can still apply reasonable restrictions. Check your local zoning and your HOA's architectural review process first.

Home-based businesses

SB24-134 bars HOAs from prohibiting home-based businesses, but reasonable rules on parking, noise, landscaping and architectural control still apply.
